Terms of Service

Effective date: July 20, 2026

These Terms of Service (these "Terms") set forth the conditions for use of "Playback18" (collectively, the app, shared pages, and related services; the "Service") provided by Takashi Miyamoto, operator of Playback18 ("we," "us," or "our"). By using the Service, you are deemed to have agreed to these Terms.

Article 1 (Description of the Service)

1. The Service uses AI to automatically generate recap videos ("Recaps") from golf-round footage recorded by users, and provides features to store, view, and share them.
2. Swing detection, player identification, carry-distance estimation, and similar outputs are AI-based estimates, and missed detections, false detections, and misidentifications may occur. We do not guarantee their accuracy or completeness.

Article 2 (Accounts)

1. Use of the Service requires sign-in with a Google or Apple account.
2. Your account may be used only by you and may not be transferred or lent to any third party.
3. You may delete your account at any time from "Delete account" in the app or via our designated web channel. Cloud data (generated recaps, share links, and account data) is deleted after a 7-day grace period; signing in again during the grace period cancels the deletion.
4. When you delete your account, purchased but unused generations (one-time and additional purchases, and the remaining count of the current monthly-plan period) are forfeited and non-refundable. Deleting your account does not cancel the monthly plan; you must cancel it separately in the store you bought from (Google Play / App Store).
5. If you can no longer sign in due to deletion or suspension of the Google or Apple account you signed in with, we cannot compensate for or transfer the account contents, including unused generations.

Article 3 (Pricing Plans)

1. The pricing plans are as follows (prices are as displayed in the applicable app store).

   Plan	Description
   Free	One free Recap generation per account, once per lifetime (the video will include a watermark). Recording, sharing, and storage features are available free of charge
   Monthly plan ($9.99/month)	Up to 4 Recap generations per billing cycle. From the 5th generation onward, an overage fee applies ($3.49 per generation). Unused generations do not carry over to the next cycle
   Pay per use ($4.99 per generation)	Payment is charged each time you generate a Recap

2. "One generation" means the generation of one round's Recap; generating both the full-group version and the you-only version counts as a single generation.
3. If generation fails due to causes attributable to us, such as a system failure, no generation is consumed. A re-generation initiated by the user (e.g., re-running after adding recordings) consumes a new generation.
4. Payments are processed through Google Play / App Store in-app purchases. Cancellations and refunds are governed by the rules of the applicable store.
5. Cancelling the monthly plan does not immediately make your generated Recaps unavailable. Recaps saved to your device remain after cancellation. For cloud retention, see Article 5, Paragraph 2.
6. Overall cap on free generations: To manage our operating costs, we may set a cap on the total number of free generations we provide across the service per month. If the cap is reached, free generation may be unavailable for the rest of that month (it resets the following month). We will show in the app that the cap has been reached and when it resets. Generations on paid plans and pay-per-use are not affected by this cap.

Article 4 (Recording and Consent of Playing Partners)

1. You must obtain the consent of playing partners and any other persons who will appear in the footage before recording and uploading.
2. Any dispute arising from recording (rights of publicity, privacy, etc.) shall be resolved at the responsibility and expense of the user who made the recording.
3. If a person appearing in the footage requests deletion, we may delete the relevant video.

Article 5 (Data Handling and Retention Periods)

1. Uploaded original videos are automatically deleted within a maximum of 14 days after generation processing is complete.
2. Cloud retention of generated Recaps depends on your plan. After the retention period, Recaps are automatically deleted and can no longer be re-downloaded in the app or turned into new share links.
   • While on a paid plan (monthly or pay-per-use): three (3) years from generation
   • Free use, or after cancelling the monthly plan: 90 days from generation (if you cancel, we keep your Recaps for 90 days from the cancellation date)
   • Recaps already saved to your device remain on your device after the retention period; we do not delete them. We will make reasonable efforts to notify you in the app before cloud retention ends
3. Share links are valid until the date shown on the share page, which depends on your plan at the time of issuance (up to 3 years). When you delete your account, issued share links become invalid at the time deletion is executed. You are responsible for how you handle issued links (who you send them to).

Article 6 (Rights in Content)

1. The rights in videos recorded by users and in generated Recaps belong to the users.
2. You grant us the right to process your videos to the extent necessary to provide the Service (generation, storage, delivery, and verification for quality improvement).
3. You may not remove or alter the watermark (logo) applied to Recaps generated under the free plan.

Article 7 (Prohibited Conduct)

• Acts that violate laws or public order and morals
• Uploading or publishing a video in which a person appears as a primary subject without that person's consent
• Recording in violation of a golf course's rules or filming policies
• Reverse engineering, decompiling, analyzing, copying, or reselling the Service
• Using the free allowance more than once through improper means (such as creating multiple accounts)
• Placing excessive load on our servers

Article 8 (Changes, Suspension, and Termination of the Service)

1. We may change the content or pricing of the Service upon prior notice.
2. The Service may be temporarily suspended due to maintenance, failures, or outages of external services (cloud, AI, etc.).
3. If we terminate the Service, we will provide at least three (3) months' prior notice and will endeavor to provide a means to download Recaps that are within their storage period.

Article 9 (Disclaimer)

1. With respect to the content of AI-generated results (missed detections, false detections, etc.), we provide no remedy beyond not consuming the generation count (Article 3, Paragraph 3).
2. If you incur damages due to causes attributable to us, our liability shall be limited to the amount you paid to us during the preceding twelve (12) months (except in cases of willful misconduct or gross negligence).
3. We are not liable for loss of recorded data due to causes beyond our control, such as device failure or network conditions.

Article 10 (Amendments to these Terms)

We may amend these Terms. We will provide prior notice of material changes in the app or on our website, and your continued use of the Service after a change takes effect constitutes your acceptance of the amended Terms.

Article 11 (Governing Law, Jurisdiction, and Language)

1. These Terms are governed by the laws of Japan, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute arising in connection with the Service.
2. These Terms are prepared in Japanese and translated into English for convenience. In the event of any discrepancy between the two versions, the Japanese version shall prevail.
